As promised, the Missouri Congressional offices met with representatives from the IRS and Social Security Administration (SSA) for 90 minutes on Dec.12 in Washington, D.C. According to reports from Senator McCaskill’s office, the Missouri Congressional delegation unanimously conveyed to the IRS and SSA that it is unreasonable and unrealistic to establish any deadline or timeframe for compliance with the changes as there remains numerous significant unanswered questions and lack of any clear guidance on the issue, which has caused considerable confusion and misinformation on this matter. Further, the delegation expressed their strong desire that the IRS and SSA provide substantive and clear direction on this matter before any enforcement is discussed or deadline is established. It was made abundantly clear that the July 1, 2009 deadline previously established is not working.

The IRS and SSA representatives indicated that Missouri’s situation is unique compared to other States in that it involves a systemwide problem – it is not limited to an individual school district. There was an understanding that it will require a unique approach to address the problem. The SSA, IRS and the Missouri Office of Administration have formed a “task force” that is to begin meeting on Monday, Dec. 19, to address this issue – the task force has been given 60 days to complete its work. The IRS indicated that there will be no retroactive tax compliance enforcement (e.g., penalties and interest) of any changes in interpretation.

The Missouri Congressional delegation agreed to send a follow-up letter to the IRS and SSA to reinforce the message conveyed during the meeting and to obtain written confirmation of the points made by the IRS and SSA at the meeting. The letter is expected to include a list of questions that remain to be answered by the IRS and SSA on this matter.
